Part 91 Daily Flight Limits

I’ve heard that pilots doing survey work and stuff like that can fly 10-12 hours a day. How is that legal? From what I understand 8 hours is the limit for a 1-2 person crew. Someone said that it’s cause it’s a part 91 operation, but that doesn’t make sense to me because part 91 is where I read the 8-hour limit.

    Part 135 involves the carriage or passengers or cargo for hire. Aerial survey does not carry passengers or cargo.

    You likely read that limitation in 91.1059. That pertains to Part 91, Subpart K, which deals only with Fractional operations.

    There is an 8 hour limit on Flight Instructors found in 61.195(a).

    As far as Part 91 operations such as survey work and such, there is no explicit statement concerning the maximum flight hours that may be flown in a day. However, if an accident or other incident were to occur, the FAA would likely charge a violation of 91.13, Careless or Reckless operation. There are several legal interpretation which support this idea.
