The following is my opinion. You may certainly ask the FAA Office of Legal Counsel for an interpretation.

Any endorsement must be given by the instructor who provided the training required for the endorsement. An instructor cannot endorse for training given by someone else.

Your use of the term “the student’s instructor” implies that you think a student may only have one instructor. That is not the case.

If your first instructor becomes ill or leaves your flight school, his endorsements are still valid, however any training required for a future endorsement must be given by the instructor who gives you the training.

Also consider, an instructor who endorses someone is stating that he/she has provided the required training. If that is not the case, that instructor would be falsifying a record. That could lead to revocation of the instructor’s certificates.

Sans, are you asking as a instructor or prospective instructor? Technical academic question (like on a practical test)? If so, I will only say that I think all the answer requires is reading the applicable regulations.

As I recall, there are only two student pilot endorsements in 61.87, 61.93 and 61.95 that do not include “by the instructor who gave the training” or equivalent language.

One of them is “real” in the sense that it is one that I have seen given (and have given myself).

The other one is arguable and, practically speaking, a purely academic exercise.

    Mark,

You are probably right that it is a candidate for a CFI practical test. If so, what he is probably looking for is the fact that I can endorse a student for a cross country flight without having given him any instruction, provided that he already has received the required instruction and has the appropriate endorsement on the back of his Student Pilot certificate and in his logbook, which were given by the instructor who provided the instruction.

For the succeeding cross country flights, it is only necessary for any instructor to review his planning for the flight and making a determination that the flight can be conducted safely. This is described in 61.195(d)(2) and there is a specific statement to this effect in AC 61-65E. (I know you know this, I’m stating it for the benefit of the poster).

To the poster, the more information you give us, the easier it is to give you a meaningful answer.
