Flight instructor as examiner conflict of interest?

Is it a conflict of interest to use a previous CFI for a Private checkride examiner?  He was not the student's last CFI, but was for the first 10 hours.  Would using him as the DPE violate any FARs or create any unnecessary problems?  Thanks!

    I think the only legal restriction on this is that the CFI who gave the last 3 hours of instruction and the checkride signoff as required by 61.109(a)(4) cannot also be the DPE.

    I have a friend whose grandfather is a DPE, and taught him how to fly – Then at the end of his training he went and got 3 hours of dual and a signoff from another CFI for the checkride, and went back to his grandfather for the checkride.

    As long as that DPE wasn’t the students CFI for the final 3 Hours (the 3 hours of checkride prep) you’ll be ok.
