Assuming pilot 1 is current in a multi engine land aircraft, there is not a legal issue. Currency is in Categrory (Airplane) and Class (Multi engine – land) and is not based on model of aircraft unless the aircraft requires a type rating. Although it is legal if pilot 1 is current even though he has not flown in the particular make and model to carry passengers, it is not necessarily the smart thing to do. I doubt that insurance would cover the flight, but that is not a legal issue.

What if Pilot 1 is not current? Can he go up with Pilot 2 and be current?

No. Pilot 2 is then a passenger, Pilot 1 can do it solo or with an instructor, but not with a passenger if they are not current.

Pilot 1 Says he never flown that Make and Model so he needs to do Solo 3 take offs and landings to be legal on that plane.

Just want to make sure that you understand that there is no rule that requires three solo takeoffs and landings in order to be allowed to take passengers in a particular make and model of airplane.

If you are indeed asking about passenger-carrying currency, as John said, is aircraft category and class specific (and type if applicable). Either Pilot 1 is current to carry passengers in the category/class or he is not. If not, it doesn’t matter if your passenger (Pilot 2) happens to have a pilot certificate in his pocket with different category and class ratings. He’s still a passenger, just as Pilot 1 is just a passenger when he is sitting in seat 23B on a commercial flight.

What should you do if Pilot 2 doesn’t want Pilot 1 to get current by himself? Go up with Pilot 2’s CFI.
